RULES OF CONDUCT
Governing Provisions. Use of the TownTalk service is subject to the provisions contained in these Rules of Conduct, as well as the provisions of the St. Joe Terms of Use, the TownTalk Terms of Use and the Privacy Policy (together the "Governing Provisions").
In order for the TownTalk service to operate properly, all users must abide by these Governing Provisions. The TownTalk service is being provided to you as a convenience and is intended to be informative, useful and even entertaining. It is hoped that the TownTalk service will allow for free exchange of ideas and information in a way that respects individual and community rights.
The TownTalk service consists of both public and private areas. The public areas include all conference areas, chat rooms, file libraries, bulletin boards, advertising areas, school and community postings, and any other areas where all users have free and full access to anything there posted. The private areas are the individual message boards and electronic mail boxes where users send and receive messages to one another. All of the Governing Provisions apply to both areas, unless otherwise specified.
Children. Parents should not permit any of their children to use the TownTalk service except under their direct supervision.
No liability. St. Joe is not liable to users for any damage resulting from use of the TownTalk service by you or those under your supervision, nor is St. Joe responsible for the conduct of other users of the TownTalk service, or information exchanged or purchases of products or services made through the TownTalk service.
Reporting problematic activity. If, through your use of the TownTalk service, you believe you have been the victim of a crime, or have been harmed in any manner as a result of the inappropriate or illegal actions of another TownTalk service user, please proceed as follows:
A. Contact the appropriate authorities. If you wish to report criminal behavior, please contact the police;
B. Contact St. Joe TownTalk service operator. Please contact St. Joe's TownTalk system operator at towntalk@towntalk.com to report any conduct in violation of these Governing Provisions;
C. Copyright infringement concerns. If you believe that your or someone's copyright has been infringed by activity on the site and you want to inform St. Joe about such activities, please follow the procedures set forth in the St. Joe Terms of Use regarding such concerns. Be courteous to other users. Users of the TownTalk service are asked to obey the dictates of common courtesy, just as you would in your everyday life correspondence. Remember not to be intentionally rude, offensive or cruel to other users in your use of the TownTalk service. Please use your best judgment, be respectful of other users, and help keep our on-line community a pleasant place to visit.
Use for lawful purposes only. Users may not use the TownTalk service for any unlawful purpose. They also may not use the TownTalk service to post or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racial, ethnic, or otherwise objectionable material of any kind or any information or material that invades or violates another's rights. This includes, but is not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law.
Sexually Explicit Material. St. Joe prohibits the transfer or posting on the TownTalk service of adult only material, sexually explicit images or descriptions involving sexual behavior, or other content deemed offensive by St. Joe according to community standards and state and federal law.
Scrolling and Disruption. Scrolling means repeatedly causing the computer or video screen to roll faster than a user is able to type, and is a prohibited form of disruption. Such scrolling can be caused by repeatedly entering the carriage return or other computer command that will roll the screen. Any action with such a disruptive effect is not permitted. Other forbidden disruptive conduct includes purposefully interfering with the normal flow of dialogue in a public conference area or chat room, and may be accomplished by repeatedly interrupting conversation or acting in a manner intended to antagonize or harass another user, or create hostility on the TownTalk service.
Impersonation: Some of you may elect to choose a TownTalk service name or alias. We encourage you to be creative and have fun with such "screen personalities," but remind you to be reasonable and responsible. Do not use an alias that is vulgar or offensive and be aware once again that young people may use the TownTalk service. You may not choose or use a screen name that belongs to another actual person, living or dead, except that you may use the name of a deceased historical figure, if doing so presents no reasonable chance of confusion. Similarly, users may not use a name protected by trademark or copyright law. At no time may users portray themselves falsely, such as pretending to be a member of St. Joe or the TownTalk service staff, or pretending to be another user of the TownTalk service, or so as to mislead others as to the source of messages sent by you.
Chain Letters and Pyramid Schemes. Transmitting chain letters or pyramid schemes of any kind is strictly prohibited on the TownTalk service. Such material places an unnecessary load on the TownTalk service email and message system and is considered a nuisance by a majority of users. Some chain letters and pyramid schemes are illegal under state and federal law.
Solicitation and Advertising. You may not use the TownTalk service or any information you may obtain through your use of the TownTalk service (including email addresses of other users) to send unsolicited advertising, promotional material, or other solicitations except in specified areas designated for such a purpose. If you are sending solicitations of any kind, please remember to comply with all applicable state and federal anti-spam laws, including by respecting those who opt out of receiving further solicitations or communications from you.
Sales of Goods and Services and Release. Sellers of goods and services may offer products and services for sale through the TownTalk service. St. Joe does not screen any such offers and thus you, as a consumer, should take care in evaluating any such offers and their source. Because St. Joe is not involved in the actual transaction between buyers and sellers of goods and services, in the event that you have a dispute, claim, cause of action or any claim against one or more users or purveyor of goods and services, you release St. Joe, and all of their respective parents, subsidiaries, affiliates, partners, officers, directors, servants, agents, employees, legal representatives, predecessors, successors, heirs and assigns, as presently or hereafter composed from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. St. Joe is not responsible for any other interaction between a seller of goods and services and you as the buyer, resulting from your providing access to yourself, your property or your personal information. Any such transactions will be at your sole risk and expense. You should be extremely careful before allowing any contact with any persons and yourself, your property or your personal information. This is particularly true if you are allowing your children to use the TownTalk service.
Monitoring. St. Joe is not obligated to monitor the content, validity or the accuracy of information exchanged on the TownTalk service and it is not St. Joe's policy to do so. However, by utilizing the TownTalk service, you acknowledge that St. Joe may at its sole discretion randomly and without prior notice monitor the content of information created, posted, disseminated, or otherwise exchanged in public areas on the TownTalk service for adherence to its policies. St. Joe reserves the right to prohibit conduct and to prohibit, modify and remove any communication or content that it deems in its sole discretion may violate the Governing Provisions, be harmful to individual users of the TownTalk service or the community, or which may violate federal or state law. Notwithstanding the foregoing, neither St. Joe nor its information providers have the practical ability to restrict conduct, communication or content which might violate its Governing Provisions prior to transmission on the TownTalk service, nor can St. Joe ensure prompt editing or removal of questionable content after on-line posting. Accordingly, neither St. Joe nor any information provider shall assume liability for any action or inaction with respect to conduct, communication or content on the TownTalk service. St. Joe encourages open and candid communication, and cannot determine in advance the accuracy of content transmitted on the TownTalk service. St. Joe is not responsible for screening, policing, editing, or monitoring such content.
Private Areas. St. Joe will not intentionally monitor or disclose any electronic communication posted or transmitted in a private area, such as an electronic mail message (e-mail) created or received by a user, unless permitted or required by law, or unless St. Joe has reason to believe, because of a complaint from a user or otherwise, that a communication posted or transmitted in a private area is in direct violation of the Governing Provisions, or is in violation of federal or state law. You hereby expressly permit the foregoing interception and monitoring and agree that St. Joe will not liable to any user whose private area transmissions are intercepted for the above reasons.
Change of Provisions, Termination of Use and Notification to Authorities: St. Joe reserves the right to change the Governing Provisions at any time. St. Joe also reserves the right to suspend or terminate any user's access to the TownTalk service without notice and with or without cause. St. Joe also has the right to take any action, without notice, against any user who violates the Governing Provisions, and to notify appropriate authorities about such activity.
