GENERAL USE PROVISIONS

ACCEPTANCE OF TERMS THROUGH USE

Welcome to the TownTalk service! St. Joe Towns & Resorts, L.P. ("St. Joe") has provided the TownTalk service to inform, assist and entertain residents of St. Joe communities. TownTalk is a free service to St. Joe community property owners or those considering a residence in a St. Joe community. By your continuing use of this site, you signify your agreement to all terms, conditions, and notices contained or referenced herein (the "TownTalk Terms of Use"). If you do not agree to the TownTalk Terms of Use please do not use this site. St. Joe reserves the right to suspend or terminate your use of the TownTalk service at any time, in its discretion.

CHANGES IN TOWNTALK TERMS OF USE.

St. Joe reserves the right, at its discretion, to update or revise these TownTalk Terms of Use. Please check the TownTalk Terms of Use periodically for changes. Your continued use of this site following the posting of any changes to these TownTalk Terms of Use constitutes acceptance of those changes. This TownTalk Terms of Use was last updated on December 16, 2004.

ST. JOE TERMS OF USE, PRIVACY POLICY AND TOWNTALK RULES OF CONDUCT.

Use of the TownTalk service is governed by this TownTalk Terms of Use, and also by the St. Joe Terms of Use, the St. Joe Privacy Policy and TownTalk Rules of Conduct, all of which are incorporated herein by reference. Please take the time to review these provisions carefully for they contain important information and guidelines regarding your use of the TownTalk service.

YOUR REGISTRATION OBLIGATIONS

You agree to provide true, accurate, current and complete information about yourself as prompted by the TownTalk service registration form (such information being the "Registration Data"), and to maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

MEMBER ACCOUNT, PASSWORD AND SECURITY

You will receive a password and account designation upon completing TownTalk's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all use made by anyone using your password or account. You agree to (a) immediately notify St. Joe of any unauthorized use of your password or account or any other breach of security of which you become aware, and (b) ensure that you exit from your account at the end of each session and take all other necessary steps to protect against theft of your password, and unauthorized use of your account and the TownTalk service generally.

DEALINGS WITH ADVERTISERS AND OTHER USERS OF THE TOWNTALK SERVICE

Your correspondence and dealings with others using the TownTalk service, including business dealings with advertisers, participation in promotions offered by others, payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the other entity or person. Unless expressly noted otherwise, St. Joe is not affiliated with any of the advertisers found on or through the TownTalk service, and receives no compensation for such advertisements. Further, St. Joe has not investigated or verified the quality of any services or products offered by the advertisers, nor does St. Joe check the information provided by users of the TownTalk service. You agree that St. Joe is not responsible or liable for any injury, loss, liability or damage incurred by you or others claiming through you as the result of the information, promotions, communications, advertisements appearing on the TownTalk service or products or services obtained through use thereof.

GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that St. Joe may establish general practices and limits concerning use of the TownTalk service, including without limitation the maximum number of days that e-mail messages, message board postings or other uploaded content will be retained by the TownTalk service, the maximum number of e-mail messages that may be sent from or received by an account on the TownTalk service, the maximum size of any e-mail message that may be sent from or received by an account on the TownTalk service, the maximum disk space that will be allotted on St. Joe's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the TownTalk service in a given period of time. You agree that St. Joe has no responsibility or liability for the deletion or failure to store any messages and other communications or other content maintained or transmitted through the TownTalk service. You acknowledge that St. Joe reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that St. Joe reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
